Rep. Poe Complains That Supreme Court Is "Stacked With Harvard Lawyers"

Rep. Ted Poe (R-TX) has released the following statement in response to Solicitor General Elena Kagan's nomination to the Supreme Court.

"As a former judge for over 20 years, I feel very strongly that any nominee to our highest court should have judicial trial experience. Currently, the Supreme Court is overly stacked with Harvard lawyers."

Poe's criticism is weak.  At least 38 of the 111 Supreme Court justices, including former Chief Justice William Rehnquist, have had no prior judicial experience.  In fact, 7 of the 9 Justices who delivered the landmark Brown v. Board of Education decision had no prior judicial record, including Chief Justice Earl Warren who served as Governor of California before being on the court.

Poe's other criticism is obviously even weaker.  The fact that Kagan attended and later served as Dean at one of the most prestigious law schools in the country only speaks to her impressive credentials.
